The Linq Group BV (hereinafter: “us”, “we” or “our”) manages the websites www.linq.group and app.linq.group. Through our websites, our customers and their employees can use our Online Services, including the online platform of The Linq Group BV.
This page contains information about our policy regarding the collection, use and disclosure of your Personal Data when you use our Online Services and the choices you have regarding the processing of that data by The Linq Group BV.
We use your Personal Data to execute the Agreement entered into with the Client, as well as to provide and improve our Online Services. By using our Online Services, you consent to the processing of your Personal Data in accordance with this policy. Unless otherwise stated in this Privacy Statement, the terminology used in this Privacy Statement has the same meaning as in our General Terms and Conditions: http://linq.group/terms-and-conditions
1. DEFINITIONS
In addition to the terms defined in our General Terms and Conditions, the following terms are capitalized and used in the following sense in this Privacy Statement:
Online Services The use of the online services offered by The Linq Group BV via the websites www.linq.group and app.linq.group
Usage Date Automatically collected data generated by the use of our Online Services or the infrastructure of the Online Services themselves (for example, the duration of the visit to a page).
Data Controller The natural or legal person who (alone or jointly) determines the purposes for which and the manner in which Personal Data are or will be processed. For the purposes of this Privacy Policy, we are a Data Controller of your Personal Data.
Data Processors Any natural or legal person who processes the data on behalf of the Data Processor. We may engage different Service Providers in order to process your data more efficiently.
Data Subject (or User) Any living person who uses our Online Services and is the subject of the Personal Data processed by us.
Personal Data Any information about an identified or identifiable natural person. This means that data are either directly about someone or can be traced back to that person.
2. DATA COLLECTION AND USE
We collect different types of data for different purposes in order to execute Agreements, to provide our Online Services to you, and to improve our Online Services.
Personal Data
When you use our Online Services, we ask you to provide us with certain personally identifiable data to log into your LinkedIn account, to contact you, or to identify you. This personally identifiable information may include, but is not limited to:
• First and last name;
• Telephone number;
• E-mail address;
• Login details of your personal LinkedIn account;
• IP address;
• Location details.
We may also use your Personal Data to contact you through newsletters, marketing or promotional materials and other information that may be of interest to you. In doing so, you may indicate at any time that you only wish to receive certain, or no, communications by clicking on the unsubscribe link or following the instructions we provide in the email message.
Usage Data
We may also collect data that your browser sends when you use our Online Services or when you access the Online Services with or via a mobile device.
This Usage Data may include information such as your computer’s Internet Protocol (IP) address, browser type, browser version, pages you have visited on our Online Services, the time and date of your visit, the time spent on those pages, the unique device ID and other diagnostic information.
When you access our Online Services with a mobile device, this Usage Data may include information such as the type of mobile device you are using, your mobile device’s unique ID, your mobile device’s IP address, your mobile device’s operating system, the mobile internet browser you are using, the unique device ID and other diagnostic information.
3. USE OF DATA
We use the data collected for a variety of purposes:
• to execute the Agreement;
• to contact you;
• to collect analysis or valuable data that we can use to improve our Online Services;
• to detect, prevent and treat technical problems;
• to provide you with news, special offers and general information about our services similar to what you have used in the past or requested information about, unless you have indicated that you do not wish to receive such information.
4. LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA UNDER THE GENERAL DATA PROTECTION REGULATION (GDPR)
If you are a resident of the European Economic Area (EEA), the legal basis for the collection and use of Personal Data as described in this Privacy Statement will depend on the Personal Data we collect and the specific context in which we collect it.
We can use your Personal Data because:
• we have entered into an Agreement with you;
• you have given us permission to do so;
• the processing is in our legitimate interest and is not waived by your rights;
• it is in compliance with the law.
5. RETENTION OF DATA
We will only retain your Personal Data for as long as these are necessary for the purposes stated in the Privacy Statement. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (e.g. if we are required to retain your data in compliance with applicable law), to resolve disputes, and to apply our legal agreements and policies.
The Linq Group BV also retains your Usage Data for internal analytical purposes. Usage Data will be anonymized unless we are required by law not to retain these data anonymously.
Personal Data are automatically removed by The Linq Group BV after the retention period has expired.
6. TRANSFER OF DATA
Your data, including Personal Data, may be transferred to – and stored on – computers located outside the jurisdiction of your province, country or other governmental authority where data protection laws may differ from those in your jurisdiction.
Please note that if you are outside the European Economic Area (EEA) and you provide data to us, we will transfer such data, including Personal Data, to the EEA and process them there. Your consent to this Privacy Statement followed by your submission of Personal Data indicates your consent to that transfer.
The Linq Group BV will take all reasonably necessary steps to ensure that your Personal Data are processed safely and in accordance with this Privacy Statement and that your Personal Data will not be transferred to an organization or a country if no appropriate controls are in place, including the security of your data and other Personal Data.
7. DISCLOSURE OF DATA
Business transaction
If The Linq Group BV is involved in a merger, acquisition or sale of assets, your Personal Data may be transferred. We will notify you before your Personal Data are transferred and become the subject of a different Privacy Statement.
Disclosure for law enforcement purposes
In certain circumstances, The Linq Group BV may be required to disclose your Personal Data if required by law or at the request of governmental authorities (e.g. a court or government body).
Legal requirements
The Linq Group BV may disclose your Personal Data if it believes in good faith that such action is necessary:
• to comply with a legal obligation;
• to protect and defend the rights and property of The Linq Group BV;
• to prevent or investigate possible abuses in connection with the Online Services;
• to protect the personal safety of users of the Online Services or the public;
• to protect against legal liability.
8. DATA SECURITY
The security of your data is important to us, but remember that no method of transmission over the internet or electronic method of storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee the absolute security.
9. YOUR DATA PROTECTION RIGHTS UNDER THE GENERAL DATA PROTECTION REGULATION (GDPR)
If you are a resident of the European Economic Area (EEA), you have certain data protection rights. The Linq Group BV strives to take reasonable measures to give you the opportunity to rectify, amend, remove or limit the use of your Personal Data.
If you would like to know what Personal Data we process about you and if you would like certain Personal Data to be removed from our systems, please contact us.
In any case, you have the following legal rights with regard to data protection:
• The right to access, rectify or delete the Personal Data we process about you. Where possible, you can access and rectify your Personal Data or request the deletion directly in your account settings. If you are unable to carry out these actions yourself, please contact us to help you.
• The right to rectification. You have the right to have your Personal Data rectified if they are inaccurate or incomplete.
• The right to objection. You have the right to object to the processing of your Personal Data.
• The right to restriction. You have the right to request that we restrict the processing of your Personal Data.
• The right to data portability. You have the right to receive a copy of your Personal Data we process in a structured, machine-readable and commonly used format.
• The right to revoke your consent. You have the right to withdraw your consent at any time if The Linq Group BV processes your Personal Data on the basis of your consent.
Please note that we may ask you to verify your identity before responding to such requests.
You have the right to file a complaint with the Dutch Personal Data Authority (Autoriteit Persoonsgegevens) regarding the collection and use of your Personal Data. For further information, please contact the Dutch Personal Data Authority (Autoriteit Persoonsgegevens).
10. SERVICE PROVIDERS
We may appoint external companies and individuals to simplify our Online Services, to provide the Service on our behalf, to perform activities as part of our Online Services, to process your Personal Data, or to help us analyze how our Online Services are used.
These third parties only have access to your Personal Data to perform these tasks on our behalf and they may not disclose them to others or use them for any other purpose.

11. LINKS TO OTHER SITES
Within our Online Services you may find links to third party services, including so-called “social media” buttons. If you click on a link or social media button of an external party, you will be taken to the site of that external party. By using these links and social media buttons of third parties, you may provide Personal Data to these third parties. We have no influence on and are therefore not responsible for the extent to which and the manner in which these third parties process your Personal Data. The processing of your Personal Data by third parties is subject to the privacy policy of the third party in question. We therefore advise you – before using the services of third parties – to read the relevant privacy policy carefully.
We have no control over and accept no liability in relation to the content, privacy policies or privacy practices of any third-party sites or services.
12. AMENDMENTS TO THIS PRIVACY POLICY
We may update our Privacy Statement at any time. We will notify you of any amendments by publishing the new Privacy Statement on this page.
We will notify you by email and/or a prominent notice on our Online Services before the changes take effect and we will update the “Effective date” set out at the top of this Privacy Statement.
